By accessing or using Stackey AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Stackey AI is a self-serve tool for generating UGC-style (user-generated-content-style) advertising videos and images, with native-language support for Southeast Asian markets (Tagalog/Taglish, Thai, Bahasa Indonesia, Japanese, and English), built on third-party AI model providers (currently fal.ai and the models it hosts). You may use the Service either (a) by connecting your own fal.ai API key and account, in which case fal.ai bills you directly and we do not process payment for generation on your behalf, or (b) by purchasing Credits from us as described in Section 4A, in which case we generate content on your behalf using our own provider accounts and deduct Credits for each request.
You must be at least 18 years old to use the Service. You may not use the Service if you are located in, or a resident of, a country, region, or territory subject to applicable trade sanctions, or where use of the underlying AI models is prohibited by their own license terms (see Section 6).
If you connect your own fal.ai API key (Section 2(a)), you are solely responsible for its security and for all activity and charges that occur through it. We store your API key locally on your own device; we do not transmit it to our servers except as strictly necessary to relay your generation requests to fal.ai.
You agree not to use the Service to create, upload, or generate content that:
This list mirrors, and does not replace, the Acceptable Use Policies of fal.ai and of the individual AI model providers accessible through the Service (see Section 6). Your use of those providers through this Service is also governed directly by their own terms, and a violation of their terms is a violation of these Terms.
The Service routes your requests to third-party AI models, each of which carries its own license terms in addition to fal.ai's platform-wide Acceptable Use Policy. As of this writing, this includes (non-exhaustively) the following model-specific restrictions, which you are responsible for complying with:
We may update, remove, or add models available through the Service at any time, and the applicable restrictions may change accordingly. It is your responsibility to review the current terms of any model you use before generating or distributing content with it.
If you publish or distribute content generated through the Service, you agree to disclose that it is AI-generated or AI-assisted, in a manner consistent with the disclosure requirements of the platform where you publish it (e.g., TikTok's AI-content labeling requirements). We do not embed this disclosure automatically on your behalf in the current version of the Service.
As between you and us, and subject to the underlying model providers' own terms, you retain the rights to content you generate through the Service, to the extent those rights exist under applicable law. We make no representation about the extent to which AI-generated content is protectable under copyright law in any jurisdiction — this is an unsettled area of law. Any pre-built characters, art styles, templates, or brand assets provided by us through the Service (e.g., the STACKEY character and related IP) remain our property, and are licensed to you for use within the Service only, not for independent commercial exploitation.
The Service is provided "as is." AI generation is inherently probabilistic: outputs may be inconsistent with prior generations of the same character or scene, may fail to complete, may be rejected by a model's own content filter (including false-positive rejections of ordinary, non-violating content), or may otherwise not match your expectations. We do not guarantee the consistency, accuracy, availability, or fitness for any particular purpose of generated content, and disclaim all warranties to the maximum extent permitted by law.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, arising from your use of the Service, including any charges incurred on your own fal.ai account, any content generated through the Service, or any violation by you of a third-party model provider's terms.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or the Acceptable Use Policies referenced in Sections 5–6.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
